Texas attorney general responds to Graham's Supreme Court appeal

AUSTIN, Texas (CNN) -- Texas Attorney General John Cornyn said his office has responded to a final appeal filed by convicted murderer Gary Graham, who was scheduled to be executed at 7 p.m. EDT Thursday.

"Unless the Supreme Court grants a stay or other relief requested by Mr. Graham, the execution will go forward today," Cornyn said Thursday afternoon.

"The Board of Pardons and Paroles has spoken," Cornyn said. "As the state's chief lawyer, I thank the entire board, who are citizens from across the state, for their careful review of this case under very difficult circumstances.

"Now is the time for the victims of Gary Graham's deadly crime spree to have the closure they deserve and the finality that our criminal justice system provides.

"Mr. Graham has been allowed to present his claims to more than 30 judges in more than 20 appeals over 19 years. His claims have been reviewed over and over again during those 19 years since he has been convicted of killing Bobby Lambert. All of those claims were found to be without merit," Cornyn said.

"Mr. Graham has filed a last appeal today in the United States Supreme Court, and we have responded. Unless the Supreme Court grants a stay or other relief requested by Mr. Graham, the execution will go forward today," Cornyn said.
