Appeals court to rule on rehearing petition in Elian case
ATLANTA (CNN) -- The 11th U.S. Circuit Court of Appeals is expected to issue a ruling around 3 p.m. EDT Friday afternoon on a petition by the Miami relatives of Elian Gonzalez to rehear his case, officials told CNN. Bill Schwartz, spokesman for the Miami Police Department, said, "We've heard the decision will be announced at 3 p.m. EDT. We don't know what the result is, but the chief is optimistic things will be calm because they were the last time. We don't anticipate any problems." The Miami relatives have asked a three-judge panel to order a rehearing before the full 12-judge appeals panel.
The three judges ruled June 1 that the U.S. Immigration and Naturalization Service was within its rights to rule that only Juan Miguel Gonzalez, Elian's father, can speak for him in immigration matters. The Miami relatives are attempting to win a ruling from the court that would force the INS to give Elian an asylum hearing. Juan Miguel Gonzalez and the Justice Department have filed briefs arguing that the three-judge panel should allow its ruling to stand and immediately lift an injunction keeping Elian in the United States. Cuban exile groups in Miami conducted peaceful protests after the appeals court's June 1 ruling.
