WASHINGTON (CNN) -- The U.S. Supreme Court delayed action Monday on convicted Oklahoma City bombing conspirator Terry Nichols' request for a new trial.

The court ordered the U.S. Solicitor General's office to file a response to the request within 30-days.

Nichols was convicted of charges of conspiracy and involuntary manslaughter in a trial that followed Timothy McVeigh's conviction in the 1995 bombing in which 168 people died.

His attorneys filed the request for a new trial last month after more than 3,100 pages of documents from the FBI's investigation of the bombing were turned over to McVeigh's attorneys.

Nichols attorney Michael Tigar said the documents could show that someone other than Nichols helped McVeigh plan the bombing.

Nichols was turned down in an earlier appeal for a new trial by the 11th U.S. Circuit Court of Appeals in Denver, Colorado, and the U.S. Supreme Court.
