Legal expert Mary Cheh discusses Beazley case

The U.S. Supreme Court has rejected a request for a stay of the execution in the unusual and controversial case of Napoleon Beazley.

Beazley is scheduled to die by lethal injection in Texas Wednesday at 6 p.m. (7 p.m. EDT) for the 1994 killing of John Luttig during a carjacking attempt. Beazley was 17 at the time.

Luttig was the father of J. Michael Luttig, a prominent federal judge with ties to Justices Antonin Scalia, Clarence Thomas and David Souter.

The three justices recused themselves from the case because of their relationships with Luttig, leading to a 3-3-3 tie.

George Washington University Law professor Mary Cheh explained that decision and other issues in the case on CNN Live This Morning.
