Father says officer's apology 'not enough'
NEW YORK (CNN) -- A man whose family was run over and killed by a New York police officer rejected an apology from the officer Tuesday, saying, "Sorry means nothing." "Sorry does not bring my family back. Sorry is not enough," Victor Herrera said at a news conference outside police headquarters Tuesday. "Fifteen years is not enough." Officer Robert Gray is charged with three counts of manslaughter in connection with the August 4 accident in Brooklyn that killed Herrera's pregnant wife Maria, the couple's 4-year-old son Andy and her 16-year-old sister, Dilcia Pena. Gray could be sentenced to up to 15 years in prison if convicted. At an emotional news conference on Monday, Gray expressed sorrow for the accident, which also led the NYPD to take disciplinary action against 17 officers. Gray was interrupted by a protester calling him a "drunk killer cop." Investigators said Gray was on his way to work after a visit to an "off-limits" topless bar where he had been drinking with fellow officers. He is accused of running a red light and striking the family. "He can't be sorry for what he did. Drinking is not an excuse for an officer to kill four people. It's not," Herrera said. Police said blood tests showed Gray's blood-alcohol level after the accident was twice the legal limit. He is free on $250,000 bail.
"There is no penalty, not enough penalty for that," Herrera said. "Nothing will bring my family back. There's no money in this world that will bring my family back. Right now, there's no peace for me." Herrera's unborn child was delivered in an emergency Caesarean section after the accident, but later died. Herrera said he and his lawyer, Oscar Herasme, on Monday met with Brooklyn District Attorney Charles Hynes to ask that the unborn child -- since named Ricardo -- be added to the indictment. The medical examiner classified Ricardo as a fetus and did not issue a death certificate, but Herrera contended the baby was breathing for a short time on his own before he died. "It's very important that he be charged for four because he killed four," Herrera said of Gray. Famed lawyer Johnnie Cochran on Monday said he has filed on behalf of the family of Dilcia Pena a claim with the city of New York. That action precedes a wrongful death suit. Herrera and Herasme did not address the lawsuit at Tuesday's news conference. |
