Trial date decision for Winona Ryder delayed

LOS ANGELES, California (CNN) -- A judge Tuesday postponed setting a trial date for actress Winona Ryder to allow her attorney to present more evidence in the case.

The actress is charged with the illegal possession of a prescription drug and shoplifting more than $6,000 in merchandise from a Beverly Hills Sak's Fifth Avenue store.

Ryder's attorney, Mark Geragos, said Tuesday he can show Ryder had a prescription for a generic form of the painkiller Percocet at the time of her arrest.

Superior Court Judge Elden Fox set a pretrial hearing for August 26 to discuss evidence that will be allowed at Ryder's trial and to set a trial date.

Ryder has pleaded not guilty to the charges.

The actress did not appear at Tuesday's hearing. She remains free on $20,000 bail.

If convicted on all charges, Ryder could face up to three years, eight months in jail.
