Court forces issue on Blake bail hearing

LOS ANGELES, California (CNN) -- The California Supreme Court ruled Wednesday that actor Robert Blake should be granted a bail hearing on murder charges, unless authorities can show sufficient reason that he is not entitled to one.

The court gave the Los Angeles County Sheriff's Department, which has custody of Blake, until Monday to provide its reasoning for not moving to have a bail hearing.

The 69-year-old actor has been in jail since April on charges he murdered his wife of six months, Bonny Lee Bakley, who was found shot to death in the couple's car outside a restaurant where they had just dined.

Blake's attorney, Harland Braun, told CNN he was confident the court would grant his client a bail hearing.

"We feel vindicated by the Supreme Court," Braun said. "We felt all along there should be a bail hearing. He should be out on bail to defend himself."

Blake's bodyguard, Earle Caldwell, is charged as a conspirator in the murder and was freed in April on $1 million bond.

Blake has a preliminary hearing November 13 in which it will be decided if there is enough evidence against him to go to trial.

After the preliminary hearing, the actual trial probably will not begin until March or April. It is expected to last two to three months.

Blake was the star of the 1970s television series "Baretta." He and Bakley had a child together, Rose, now 2 years old.

Blake's adult daughter was awarded custody of the girl last month, over the objections of Bakley's family.
