MALIBU, California (CNN) -- Actor Nick Nolte entered a substance abuse treatment program after his arrest on misdemeanor DUI charges, his lawyer said Thursday.

The 61-year-old Oscar-nominated actor was arrested September 11 after police observed his black Mercedes-Benz driving erratically on Pacific Coast Highway in Malibu, according to Los Angeles district attorney spokeswoman Jane Robison.

Nolte was charged with one count of driving under the influence of alcohol or drugs and one count of being under the influence of a controlled substance known as gamma-hydroxybutyrate or GHB, the so-called date rape drug.

A California judge Thursday postponed Nolte's arraignment until December 12 while Nolte negotiates a settlement with prosecutors, according to his attorney Mark Werksman.

Werksman told reporters Thursday that Nolte has no idea how the illegal substance entered his bloodstream but suspects it could have come from numerous nutritional supplements the actor takes as part of a physical conditioning program.

Werksman said the actor, who was released on bail, checked himself into treatment voluntarily but continues to work on several projects.

He is starring in three motion pictures scheduled for release next year, Worksman said.
